Terms and Conditions of Participation in Product Testing

These General Terms and Conditions of Participation apply to Julbo eyewear tests (the “Eyewear Tests”). By taking part in an Eyewear Test, the participant (the “Participant” or “You”) fully agrees to these General Terms and Conditions of Participation (the “GTC”). Please read these GTC carefully before participating in any Eyewear Test. If you do not accept the GTC, you will not be able to participate in the Eyewear Test.

The Eyewear Test is organized by Outdoor Perspectives SARL, a company governed by French law with its registered office located at 1 impasse des marais – Bâtiment Altitude 2, PAE Les Glaisins, 74940 Annecy, France (the “Organizer”). The Organizer acts on behalf of various brands, including Julbo.

1. The information provided by the Participant in the registration or test forms must be accurate and complete.

2. The Eyewear Test is open to individuals aged 14 and older. If the Participant is under 18, they may only take part in the Eyewear Test with the consent of their legal guardians. Legal guardians must present valid identification to give their consent.

3. Before accepting the Eyewear Test, the Participant must provide, as a security deposit, an official photo ID (identity card, driver’s license, etc.) or another form of collateral, which will be returned after the tested product has been duly returned. The Organizer will make a copy of the official photo ID for identification purposes during the Eyewear Test.

4. The test eyewear will be provided to the Participant for testing purposes only. The test eyewear is used at the Participant’s own risk. The Participant will adjust their behavior according to their ability and the environmental conditions (weather, light, etc.). The Participant shall refrain from using the eyewear in inappropriate contexts (e.g., driving, hazardous activities) and agrees to follow all safety recommendations.

5. The Participant confirms that the test eyewear was in good, usable condition when received. The Participant agrees to handle the eyewear with care and to cover any damage or loss. The eyewear may only be used in the designated test areas.

6. If the test eyewear is not functional, the Participant must return it immediately.

7. The Participant must return the test eyewear immediately upon request. If not, the Participant agrees to return the test eyewear no later than the return deadline indicated in the test form.

8. The Participant must not, under any circumstances, give the test eyewear to a third party. If the Participant does lend the eyewear to someone else, they remain fully liable for any damage (including incidental damage) that would not have occurred had the eyewear remained in their possession.

9. Liability

The Participant acknowledges that participating in sports or outdoor activities while wearing eyewear can be dangerous and may result in BODILY INJURY or DEATH.

The Participant voluntarily accepts all risks of death and injury that may arise from such activities or from their participation in the Eyewear Test.

THE PARTICIPANT AGREES TO TAKE ALL NECESSARY PRECAUTIONS TO AVOID PUTTING THEMSELVES OR OTHERS IN DANGEROUS SITUATIONS. IN PARTICULAR, THE PARTICIPANT AGREES TO:

• USE THE EYEWEAR IN APPROPRIATE CONDITIONS,

• COMPLY WITH ALL SAFETY RULES APPLICABLE TO THE ACTIVITY OR ENVIRONMENT.

Furthermore, the Participant agrees to follow the Organizer’s instructions during the Eyewear Test.

In view of the above, You agree to indemnify and hold harmless the owners, manufacturers, service providers, and resellers of the tested equipment, as well as any indirect agents, legal representatives, and legal successors (the “Suppliers”), from any injury, death, financial loss, or other damages arising from your participation in the test and/or use of the test products. This waiver of liability does not apply in the case of willful misconduct or gross negligence by the Suppliers, or for any damages resulting from death, physical injury, or health impairment caused by serious breaches of the Suppliers’ obligations. The limitation of liability also does not apply where mandatory legal liability applies (e.g., under applicable product liability laws).

10. Participants are strongly advised to have valid insurance coverage, including personal insurance (for medical expenses, disability benefits, hospital costs, repatriation, etc.), repatriation insurance (if applicable), and third-party liability insurance.

11. Privacy

Personal data is controlled by the Organizer. The Organizer’s privacy policy for its partner is available at: https://www.julbo.com/fr_fr/privacy-policy (the “Privacy Policy”).

By participating in the Eyewear Test, you accept the Privacy Policy and consent to the collection and processing of all personal data, including but not limited to name, address, copy of ID, photo, signature, etc., provided as part of the Eyewear Test by the Organizer and/or any third party acting on its behalf. The data will be processed for the purpose of managing the Eyewear Test and may be shared with third parties to the extent necessary for the organization of the test.

If you give your consent, the Organizer may also use your personal data to send you information and promotional offers via email, SMS, or other digital communication channels. If personal data is shared with third parties outside the EEA, the Organizer will ensure appropriate data protection measures are in place in accordance with applicable binding data protection legislation.

12. Miscellaneous Provisions

To the fullest extent permitted by applicable mandatory law, these GTC shall be governed by French law.
